There are criteria for waivers– obviously, the older the offense the better your chances. Hopefully there was no real violence (misdemeanors are usually non-violent offenses). Look at the criteria, then make sure you emphasize them when you write your request for a waiver– e.g., if they say they take the age of the offense into account, make sure you point out how old it is. If they deny you, request an appeal and go to it– the judges are usually very reasonable. Also, see if you can get the past crime expunged from your record. There should be a legal aid center near you, find out if they have an expungement clinic– my law school did. I bet you get the waiver– most people I helped did, but it’s a different state.
There should be some sort of certification board or committee you can contact. Google
will turn up something. Ask them through email or telephone. Sometimes you can get
lucky on the phone and have your answer in minutes.
