I Really Dont Think Its Fair!!! Is There Anything I Can Do?

By CNAGuide

I am currently 6mon pregnant and I work as a CNA.I have been already been working for my job for more then a year already. When i first got my job they did tell me that doctors notes does not count for ANY call outs. I really don’t call out unless i really have too but within 180 days i called out 5 times, there policy is by the 5th call out you get 3 days suspension now by the 6th call out you automatically get terminated. Let me just add that thur out the whole time i have been pregnant i have been to work and doing double shifts (16hrs) being pregnant throwing up,sick to my stomach that i can’t take it and i still did not call out when i say the only time i call out is if its in really of a need and i always try to find coverage. I work when they ask me if i can stay like. I really like my job i feel very comfortable. But now I am getting to my situation. Today i went to talk to my human resource person and asked them. “Lets say that towards the end of my pregnancy and i am still working in the middle of the night i start getting pain and i have to go to the hospital and the next day i have to work and i call out well i still get terminated or if i bring in a doctors note saying that i was at the hospital with some labor pain(in case of a false alarm type of thing) they told me that they can not grantee that i will still have my job but that if that is to happen just to save my behind that i come into work talk to my supervisor and she can send me home.” Like i really find that very unfair because i am pregnant i can not choose when my daughter is born. I am not asking for special treatment honestly cause i am a good worker and to me my pregnancy is not a disease that i can not continue my job. but i do find that it is unfair because like i mention earlier i do like my job and my co-worker just everyone there. we all get along Is there anything i can do? Please someone give me some real advise that may know about my situation…

I experienced the same kind of policy when I worked for St Davids. It was horrible. One of my coworkers had a seizure while on the clock and fired her because it was considered an unexcused absence. Unfortunately, there is nothing that you can really do. I would suggest that you speak with an attorney about the it but the fact is that companies have certain attendance policies and they can fire you if you do not abide by them, no matter what the situation may be.
