So What Now? How Do I Get My Child Back?
I had to send my son on a court ordered visitation with his father for christmas break in La. Once our son got there he immediatly started calling social services claiming I was abusing the child, (not true) but a investigation had to be done, so they told the father he didn’t have to return the child to me in the state of Wi. until the investigation was over with, so he wasn’t returned when he was supposed to be which was Jan 2nd. The investigation was concluded on Jan. 14th and everything was concluded unsubstantiated and the father was told he would have to return the child unless he went to his court system and filed for custody there in the state of La. (which he did) and now the law and social services say they can’t do anything due to the fact that he now has custody of the child there in La. I have contacted a lawyer and although he says it’s not fair it can be done and the only thing he can suggest is for me to hire a lawyer in the state of La. and fight for custody of the child down there and oh yea it will cost me at least double the price that it would for me to hire a lawyer to do a case in the same state as me, but I can’t hire one here to help me, cause they can’t leave the state or even try to work in another state, but to hire a lawyer here you have to come up with $1500.00 retainer fee and that don’t include the hourly fee or anything else that may require pay. I work as a CNA, and I do the best that I can but I’m barely making ends meet as it is there is no way I can come up with the money for a lawyer. Anyone have any ideas? Please help!!!!

I don’t know alot about legal situations, but i’m guessing your son is unhappy living with you. Let him be happy, and see if you can arrange to visit him at all times possible. Don’t let your son be unhappy for your own happiness

Maybe you could try to find a lawyer that would do it pro bono. It’s hard to get a lawyer to do it, but maybe there is one who might have a little compassion in your situation and atleast give you a discount.
Keep calling attorneys…you will pull someones heartstrings and they will help you. I wish you the best of luck..

I’m being completely useless in the answer category here but I have to state: HOLY CRAP. WTF? I’d go punch him in the face. Seriously. That’s lame… I’m so sorry.
I would call the courthouse in LA. Just because he filed for custody of the child doesnt mean it is automatically granted… After filing you still have to have a hearing in which BOTH parents must be present. From there the judge will decide who is the better fit for the child to stay with. And the court should also be able to have a public defender present for you as well if you cannot afford a lawyer.
legal aid, or kidnapp him….bounty hunters? its cheaper too seriously. if someone took my child away from me id kidnapp him or her back. after all it is ur child
There are no good answers for you. The good news is that CNAs can get employment anywhere. If I were you, I’d try to raise the money and then temporarily move to LA for this fight.
Get your butt in your car ASAP and drive directly to the kids fathers house and tell the kid to get his butt in the car.
I am not sure if you have the system there they they have here… we call it Legal Aid (if you do then probably a different name) but they help fund custody cases if they find the person applying is not able to pay for it themselves (you have to show proof of financial hardship – such as bank account statements). I had a quick look online at places that offer this service in Los Angeles…http://www.ehow.com/how_4615522_lowincom…http://www.nls-la.org/ – Try calling them and asking if they are able to help or can they advise on how to proceed etc.
Worst comes to worst, contact the Family Court in LA and ask them to send you the paperwork for file an Application with the Court and prepare it yourself. It may sound like a scary but it is better then losing your child. You reallly need to get something done in the court system because atm he has every right to keep the child in his custody.
Just went through something almost exactly of what your going through. Well actually it was my son and daughter in law. Try the following, it may help……………….
1. Do a monthly expense report (make sure you are able to financially take care of the child question).
2. Call family court (government) that services your city.
3. Pose your dilemma to them and they can tell you what you can do on your own through them to get your kid back.
how old is the child ? is he school aged and does the father have him enrolled in school, the reason i ask is because most school systems in the united states require that the child be withdrawn from one school in order to attend another, to do this the parent that enrolled the child must sign to have the child withdrawn from one state to another or show a custody order changing the custody of one parent to another, this could be your out in order to show that the father hasnt enrolled the child or hasnt done it properly, if he doesnt have him enrolled he could be facing some problems with truancy which is a big problem that he will have to explain to the state at this point the state will get involved and will force you or him to enroll the child
